Acceptable Usage Policy (AUP)

This Acceptable Usage Policy (AUP) governs the use of services provided by Owlytic Web Solutions. By using our services, you agree to adhere to this policy. Violations may result in suspension or termination of your account. In case of disputes regarding the interpretation of this policy, Owlytic Web Solutions’ commercially reasonable interpretation shall prevail.


General Policy

Owlytic Web Solutions provides web hosting, domain registration, social media management, web design, graphic design, and other digital services to businesses and individuals. As a shared hosting provider, our services are designed for fair use by multiple customers.

We reserve the right to suspend or terminate accounts that misuse our services, violate this AUP, or interfere with the experiences of other customers.


Appropriate Usage

Owlytic Web Solutions’ services are designed to support small and medium-sized businesses. Our shared hosting platform is not intended for:

  • Large enterprises with sustained high-demand usage.
  • Hosting accounts primarily used as online storage or file archiving systems.
  • Activities that place excessive load on shared resources, impacting other users.

Resource Usage

To ensure equitable performance across our shared hosting servers, customers are required to adhere to the following resource usage guidelines:

  1. CPU Usage:

    • May not exceed 25% of system CPU resources for more than 90 seconds.
    • Activities such as CGI scripts, FTP uploads, and excessive HTTP requests are examples of misuse.
  2. Prohibited Activities:

    • Distributed computing software (e.g., SETI@home).
    • Hosting publicly downloadable binary files.
    • Running unattended server-side processes or IRC applications.
    • Operating gaming servers or file-sharing services (e.g., BitTorrent).
    • Setting Cron Jobs to execute more frequently than every 15 minutes.
  3. Bandwidth Allowance:

    • Each hosting package includes a specific bandwidth allocation. If usage exceeds the limit, we may:
      • Suspend the account until the next billing cycle.
      • Require an upgrade to a higher-tier plan.
      • Charge additional fees for overages.
    • Bandwidth resets at the start of each month and unused bandwidth does not carry over.
  4. Email Storage:

    • Email storage scales with the customer’s account limits and appropriate business needs. Abuse controls may impact folder sizes or growth rates to ensure system stability.

Prohibited Content

Customers may not use Owlytic Web Solutions’ services to host, transmit, or distribute content that:

  1. Constitutes child exploitation, pornography, or excessive violence.
  2. Promotes illegal activities, gambling, drug use, or arms trafficking.
  3. Contains hate speech, harassment, or defamation.
  4. Violates copyrights, trademarks, or intellectual property rights.
  5. Interferes with public safety, incites violence, or compromises national security.
  6. Is otherwise illegal or fraudulent under applicable laws.

Security Obligations

Customers are responsible for:

  • Maintaining the confidentiality of their passwords.
  • Using secure practices for accessing accounts and data.
  • Avoiding activities such as password cracking, unauthorized access, and port scanning.

Email Policies

  1. Bulk commercial emails are permitted only if:

    • Recipients have explicitly opted in to receive communications.
    • Emails comply with the CAN-SPAM Act or similar applicable laws.
    • The email’s source is not obscured or misrepresented.
  2. Unsolicited emails (SPAM), harassment, or mail bombing is prohibited. Violations may result in immediate suspension or termination.


Copyright and Intellectual Property

Owlytic Web Solutions respects intellectual property rights and requires customers to do the same. You may not publish, distribute, or store copyrighted material without proper authorization or legal permission. Repeat violations will result in service termination.


Internet Abuse

The following activities are strictly prohibited:

  1. Unauthorized access to systems, networks, or data.
  2. Interfering with services through denial-of-service (DoS) attacks or other disruptive activities.
  3. Forging headers in TCP/IP packets or emails.
  4. Monitoring or scanning networks without authorization.

Takedown Notices

Owlytic Web Solutions complies with South Africa’s Electronic Communications and Transactions Act. Takedown notices may be directed to the Internet Service Providers’ Association (ISPA):


Newsgroup and Forums Compliance

Customers participating in newsgroups, forums, or chat rooms must comply with the rules of each platform, including restrictions on commercial posts and off-topic content.


Disclaimer

Owlytic Web Solutions does not actively monitor customer activities but reserves the right to investigate and address violations of this policy. We disclaim responsibility for misuse of our services by customers.


Violation of AUP

Violations of this policy may result in:

  • Suspension or termination of services.
  • Immediate removal of offensive or prohibited content.
  • Denial of refunds for accounts terminated due to AUP violations.

Owlytic Web Solutions reserves the right to update this AUP without prior notice. Customers are encouraged to periodically review the AUP to remain compliant.
